- These Terms & Conditions (“Terms”) govern the use, access, ownership, leasing, and display of all Castle Club digital estates, including use of our website, services, subscriptions, Suites and Studios (“Units”), and related content (collectively, the “Site”).
- By accessing or using the Site, purchasing, leasing, or accessing a Unit, the User (“You”) agrees to comply with these Terms and all applicable laws and regulations in Canada.
- If you do not agree, you must discontinue use immediately.
2. Eligibility
- You must be at least the age of majority in your province or territory of residence to use this Site.
- By using the Site, you represent that you have the legal capacity to enter these Terms.
3. Acceptable Use of the Site
- You agree to use the Site only for lawful purposes.
- To maintain a safe, respectful, and inspiring ecosystem, all Users must comply with the following:
3.1 Prohibited Content
- You may not upload, display, distribute, or conduct any activity within a Suite or Studio that includes:
- Illegal content of any kind
- Content that violates Canadian, U.S., or international law
- Vile, hateful, or abusive content
- Harassment, exploitation, or incitement to harm
- Extremely graphic, violent, pornographic, or obscene material
- Uploading or transmitting harmful code (viruses, malware).
- Infringing intellectual property right
- Harassing, abusing, or threatening others.
- Misrepresenting your identity or affiliation
- Malicious code, malware, or cyber-threats
- Any content intended to cause reputational harm to others
- Castle Club reserves the right to define and interpret what constitutes prohibited content in alignment with legal, ethical, and community standards.
4. Intellectual Property
- All content on the Site (text, graphics, logos, images, software) is owned by or licensed to us and protected under Canadian copyright and trademark laws.
- You may not reproduce, distribute, or modify any content without prior written consent.
5. User-Generated Content
- If you submit content (reviews, comments, uploads), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and distribute that content.
- You are solely responsible for the legality and accuracy of your submissions.
6. Privacy
- Your use of the Site is also governed by our Privacy Policy, which complies with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

7. Subscription Terms
- Certain features of the Site may require a paid subscription.
- Billing & Renewal: Subscriptions are billed on a recurring basis (annually). Unless cancelled, subscriptions automatically renew at the end of each billing cycle.
- Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle; no partial refunds are provided.
- Changes to Fees: We reserve the right to adjust subscription fees with prior notice. Continued use after fee changes constitutes acceptance.
- Trial Periods & Promotions: Any free trial or promotional offer is subject to these Terms and may be modified or withdrawn at our discretion.
8. Accessibility Compliance
- We are committed to ensuring digital accessibility for all users, including persons with disabilities.
- Our Site complies with the Accessible Canada Act (ACA) and applicable provincial accessibility legislation (e.g., Accessibility for Ontarians with Disabilities Act (AODA)).

11.Community Oversight
- Castle Club is a community-supported ecosystem.
11.1 Reporting Mechanism
Users may report undesirable or inappropriate use of any Unit. To report inappropriate online content, first use the platform’s built-in reporting tools for issues listed in section 3.1 of this policy. Most platforms have an in-app or on-site “Report” link (often found under a “More” or three-dots menu). This allows the platform’s review team to assess the content against their specific community guidelines and terms of service. All major social media, gaming, and video platforms have a “report” button or a similar option near the content itself. Select the reason for the report and provide any additional details when prompted by the platform’s guidelines.
Reports will be reviewed in good faith.
11.2 Community Vote
In cases requiring broader input, the community may elect to vote on whether certain content or behavior falls outside acceptable standards.
11.3 Final Authority
While community input is valued, the final decision rests solely with Castle Club Inc. administration.
Administration decisions are binding and not subject to appeal.
Castle Club may take corrective actions including:
• Warning the User
• Temporary suspension of a Unit
• Content removal
• Permanent revocation of rights to use a Unit (without refund) in extreme cases
12. IP Connections
Each Unit must be connected to an IP address (“IP Connection”) to publish or serve content publicly.
12.1 Base Allowance
• All Units without an active membership receive one (1) free IP Connection per year.
• Castle Club will make commercially reasonable efforts to grant IP Connections promptly.
13. Limitations and Delays
Users acknowledge that delays may occur, including but not limited to:
• Power outages
• Grid instability
• Hardware failure
• Backend constraints
• Administrative bottlenecks
• Security checks
• Network maintenance
These delays are normal and shall not be held against Castle Club.
Castle Club does not guarantee immediate or uninterrupted IP provisioning.
14. Ownership and Rights
14.1 Suites and Studios
• Units are digital estates available for purchase or lease.
• Ownership grants the right to occupy, customize, publish content, lease, or resell (via Castle Club marketplace).
14.2 Intellectual Property
Users retain all rights to their original creations hosted within their Units, except content deemed prohibited under Section 2.
14.3 Revocation Rights
Castle Club may revoke access to a Unit if:
• A User violates these Terms
• A Unit is used for illegal or harmful purposes
• There is continued non-compliance after warnings
Revocation does not entitle Users to a refund unless otherwise mandated by law.
15. Warranties and Disclaimers
Castle Club provides Units “as is” and “as available”.
We do not warrant that:
• Services will be continuous or uninterrupted
• IP Connections will be immediately available
• Power or grid issues can be fully mitigated
• All content storage will be perpetual
You acknowledge that digital services inherently involve delays and service constraints.
16. Limitation of Liability
- To the maximum extent permitted by Canadian law, we are not liable for:
- Indirect, incidental, or consequential damages.
- Loss of data, profits, or business opportunities.
- The Site is provided “as is” without warranties of any kind.
17. Indemnification
- You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Site or violation of these Terms.
18. Governing Law
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
- Any disputes will be resolved in the courts located in Toronto, Ontario.
19. Resolution
- Consumer Rights Protection: Nothing in this section limits or waives your statutory rights under Canadian consumer protection laws, including the Consumer Protection Act, 2002 (Ontario) and equivalent provincial legislation. If any provision conflicts with mandatory consumer rights, the consumer rights shall prevail.
20. Changes to Terms
- We reserve the right to update or modify these Terms at any time.
